RESTRICTIONS
You must be 18 years of age or over and hold a valid credit card or a pay pal account to purchase VAYO products.
SWISS-VAPE AG reserves the right to cancel any transactions based on its sole discretion if there is reason to believe that the buyer is a minor or purchasing for a minor.
DATA PROTECTION & PRIVACY POLICY
SWISS-VAPE AG will not pass on any customer details to a third party without your permission. The data we collect is used to fulfill your order and for in-house marketing campaigns. This information is lawfully collected in accordance with the Data Protection Act. By providing your personal data to us you are consenting to its use in accordance with these Terms and our Privacy Policy.
LIABILITY
To the extent allowed by the law, SWISS-VAPE AG will not be liable for any direct, indirect or consequential loss or damage arising out of the services or products sold from or referred to on this site in these circumstances:
Your understand and you agree that we (including our parent, subsidiaries, officers, agents and employees) will not be liable to you in contract, tort or otherwise for I) loss of profits or goodwill; II) loss of data; II) any indirect damages like loss or damage caused by a virus etc
FORCE MAJEURE
We will not be liable in any way for loss, damage or expense that you incur arising directly or indirectly from any failure or delay in performing any of our obligations under these Terms caused by any circumstances beyond our control, which include but are not limited to vandalism, accident, break down or damage to machinery or equipment, fire, acts of God, strike or shortage of materials when the order is accepted
OUR PRODUCTS
The products are as described on this Website but please note that slight variations may occur between the delivered Product and the image of the Product given on the Website.
HOW TO ORDER
We only accept orders from people aged 18 years or above. You may place an order directly with our company SWISS-VAPE AG; our agents or by opening an account on the Website. The Website contains instructions on how to complete the order process.
By placing an order, you authorize us to immediately charge your credit card or your PayPal account for the purchase price and we are entitled to rely on your placing of an order as an instruction to us to take your payment.
We reserve the right to reject any order for any reasons at any time prior to our confirmation of the acceptance of your order.
PAYMENT
Unless a credit arrangement has been set up and approved, all payments are due before the items are dispatched. In cases of credit accounts, payment is due 14 days from date of invoicing. SWISS-VAPE AG reserves the right to withhold and suspend deliveries when a payment is overdue.
We do not store credit card details nor do we share customer details with any 3rd parties.
You may pay for the Products via PayPal or credit card or a direct bank transfer into our bank accounts.
PRICES
The prices quoted on the website are in Swiss Francs or in Euro and are inclusive of VAT. Shipping orders to Switzerland and its neighboring countries which amount to a minimum of Euro 50 and CHF 60 will be shipped free of charge. Delivery charges to other countries as well as Duties and Taxes will be communicated to the customer at the time of ordering.
The Prices are subject to change without prior notification and will only be made prior to entering a contract with customers.
COMPLAINS AND RETURNING FAULTY PRODUCTS
You must check the items upon receipt and notify SWISS-VAPE AG within 7 working days of delivery if the product has any damage or is faulty. Once the 7 working day period has passed, you will be deemed to have accepted the products.
Any damaged or faulty items must be returned using original Packaging at your expense. The item must be adequately insured against loss and/or damage in transit. We are not responsible for any packages lost in transit and will not issue a refund in such circumstances.
You have a statutory duty to take reasonable care of the items. You will receive a refund of all monies paid for the item (except for return postal charges) within 30 days of cancellation if the products delivered to you are damaged or faulty and if they are properly returned to SWISS-VAPE AG together with your written complaint.
You will be liable for the cost of fixing any damage caused by you.
Returned items must include your name, address and when it was originally purchased. Alternatively the invoice/order number must be provided.

AVAILABILITY
Orders are subject to stock availability. If your choice is not available, SWISS-VAPE AG will contact you to offer either one of the following:
1. An alternative item – if the item is less in value, then a refund covering this will be arranged. If the item is more in value, then additional payment will be required before the item can be dispatched.
2. A refund of the value of the ordered item.
If we cannot make contact with you, SWISS-VAPE AG reserves the right to provide a suitable alternative at no extra cost.
MISCELLANEOUS
You may not resell any Product to any third party. If we become aware that you have, or have attempted to, sell the Product to a third party, we may, at our sole discretion, refuse to accept further orders from you and/ or cancel your account.
These terms and any document expressly referred to in them constitute the whole agreement between you and us.
We may assign or transfer our rights and obligations under these Terms to any company within our group, without any further consent from you. You may not assign or transfer any rights or obligations you have under these Terms to any other party without our prior written consent.
We may change, modify or revise these Terms at any time. Any changes made to the Terms will apply to all orders placed on or after the date on which the changes to the Terms are uploaded on our Website. It is your responsibility to check that you have read and agree with the latest Terms on the Website.
JURISDICTION
This contract shall be construed and governed by Swiss Law and all disputes arising under or relating to the product shall be the subject of jurisdiction of the Courts of Zürich, Switzerland, to which SWISS-VAPE AG and the customer hereby submit.
